Mr. Penn practices in all facets of labor and employment law. His employment practice includes representing clients in employment discrimination claims under Title VII, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Family and Medical Leave Act and the various state counterparts to these federal laws. He is involved in litigating employment discrimination claims as well as investigating and responding on behalf of management to employee claims before administrative agencies. He has many years of experience representing employers in workers’ compensation claims. Mr. Penn’s labor law practice includes union avoidance, elections, objections to elections, strikes and injunctions, arbitration and unfair labor practice charges before the National Labor Relations Board. Mr. Penn also regularly counsels and litigates issues relating to non-competition, non-solicitation and confidentiality agreements. In addition to representing clients in federal and state court and before federal and state agencies, Mr. Penn’s practice includes advising clients on employment-related matters and drafting personnel policies, employment contracts, severance agreements and employee handbooks. Mr. Penn’s practice also involves corporate matters. He assists clients in drafting and reviewing contracts on a wide variety of subjects. He also has experience litigating contract disputes in both federal and state court. Mr Penn chairs the firm's Practice Management Committee. From 1987 to 1989, Mr. Penn served as a law clerk to the Honorable Edward H. Johnstone of the U.S. District Court for the Western District of Kentucky. |
